Terms and Conditions
1. Acceptance of Terms
By accessing or using Ekko ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service. These terms apply to all users, including visitors, registered users, and subscribers.
2. Description of Service
Ekko is a validation platform for solo founders that provides AI-assisted landing page generation, waitlist capture, market research reports, competitive intelligence, and related tools. The Service is operated by xLabs (Pty) Ltd, based in Cape Town, South Africa.
3. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using Ekko you represent that you meet these requirements.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep it up to date. Notify us immediately of any unauthorised use of your account.
5. Credits and Billing
Access to certain features requires the purchase of credits. Credits are non-refundable except where required by applicable law. Pricing is displayed at the time of purchase and may change with reasonable notice. Unused credits do not expire unless your account is closed or terminated.
6. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the Service or its infrastructure; (c) use automated means to scrape, copy, or extract content without permission; (d) misrepresent your identity or affiliation; (e) interfere with the integrity or performance of the Service; or (f) use the Service to generate content that is defamatory, fraudulent, or harmful to third parties.
7. Intellectual Property
All content, trademarks, and software comprising the Service are the property of xLabs (Pty) Ltd or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your own lawful business purposes. Reports and outputs generated by the Service for your account are yours to use, subject to these terms.
8. User Content
You retain ownership of any content you submit to the Service (such as business descriptions or target market inputs). By submitting content you grant xLabs a limited licence to use that content solely to operate and improve the Service. We will not sell your content to third parties.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any report or analysis will be accurate or complete. Market data and AI-generated insights are for informational purposes only and do not constitute financial, legal, or business advice.
10. Limitation of Liability
To the fullest extent permitted by law, xLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.
11. Termination
We may suspend or terminate your account at any time if you breach these terms or if we decide to discontinue the Service. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email or a prominent notice in the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
